In a Decision – Stein v. Stein (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that since Divorce Agreement provided for an attorney fee award to a party, the Court can rely upon that provision without resort to the Court Rules to award attorneys’ fees to the successful litigant.
The Appellate Division noted the parties expressly included an attorney fee provision in their Divorce Agreement and trial court was not required to apply the factors embedded in court rules awarding attorney fees. Nevertheless, trial court did consider the parties' unequal financial positions and found the fees and costs incurred were reasonable.
