The Appellate Division affirmed the Trial Court determination that the father’s rights as to the child could be restricted.
The Appellate Division set forth that parental rights could be restricted when the parental relationship caused the child physical or emotional harm. The Appellate Division determined that the trial judge evaluated children's best interests and reached a fair and sensible solution. Father's right to information was accommodated. Notwithstanding a parent's presumptive fundamental rights to the care and companionship of a child, those parental rights may be restricted when the parental relationship causes the child physical or emotional harm.
