The Appellate Division affirmed the Decision of the Trial Court determining that no Changed Circumstances Occurred warranting the change of custody from a previous Consent Order.
Father had presented an application to change custody from Mother based upon alleged events and the circumstances of mother’s new boyfriend. The Appellate Division held that Although Mother’s boyfriend exhibited concerning behavior and had a criminal record, the Appellate Division did not find he posed a threat to the health and safety of the child.
