In a Decision – C.M.K v. S.K.,, (an Unpublished Opinion) >> the Court Held:
The Appellate Division affirmed the Family Part decision finding Domestic Violence. During the occurrence of the Divorce, the Husband and Wife reached an agreement to cease marital relations and live in separate areas of the marital residence. Husband had committed the predicate act of harassment, because the clear purpose of his conduct in preventing Wife to leave the residence was to alarm or severely annoy. The Trial Court determined that Husband’s escalating conduct made Wife fearful and necessitated the entry of a Final Restraining Order to prevent further abuse.
