Asset Sale – Use Business sale to pay Alimony
In a Decision – Stenger v. Stenger (an "Unreported Decision") >> the Court Held:
The Appellate Division determined that the income received from the sale of a business can be used to determine alimony even if the sale of the business was an asset that was shared by the ex-spouse.
The Appellate Division affirmed holding the motion judge did not err in considering the sale of his business when weighing appellant’s ability to pay alimony as there was no indication in the PSA that the parties intended to exclude such proceeds.
