The Appellate Division exercised original jurisdiction and voided the Prenuptial Agreement. The record here firmly convinced the Appellate Division of the prenuptial agreement's invalidity. The record lacks any convincing evidence that Husband, before signing the agreement, "consulted with independent counsel" or that he "voluntarily and expressly waive[d], in writing, the opportunity to consult with independent legal counsel." N.J.S.A. 37:2-38(c)(4).
