In a Decision – State v. K.W., (an “Unreported Decision") >> the Court Held:
The Appellate Division held that Victim's uncontradicted testimony authenticated the telephone call and sufficient credible evidence in the record supported defendant's conviction.
The Domestic Violence Order prohibited defendant from having "any oral, written, personal, electronic, or other form of contact or communication with" victim. Victim testified defendant called him and he recorded the call and it was played at trial. Defendant did not testify at trial or call any witnesses. Trial court found victim's testimony that the call was placed and he recognized defendant's voice established the elements of contempt.
