In a Decision – A.C.-G. v. A.C. (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Decision of the Trial Court determining that Domestic Violence did occur.
The judge found the testimony and evidence troubling but also noted the timing and failure to contact the police did not "make any sense" to the Judge. On appeal, the court reversed, finding the lower court judge erred in her determination that Husband's actions did not constitute a predicate act of domestic violence. The Appellate Court found Wife alleged and provided significant evidence of multiple criminal statute violations. And that there was adequate evidence in the record to show Wife needed the FRO for protection. Therefore, the Appellate Court remanded to the lower court to grant the Final Restraining Order.
