In a Decision – Imperatore v. Imperatore, (an "Unreported Decision") >> the Court Held:
The Appellate Division reversed the Trial Court because the Trial Court did not provide findings of fact and conclusions of law.
The statement of law expressed in a footnote did not satisfy the mandate of Rule 1:7-4(a) which required a trial judge to make findings of fact and conclusions of law on motions that were appealable as of right. Trial judge's order did not explain his decision and made appellate review impossible.
