In a Decision – Pathri v. Kakarlamath, (a "Reported Decision") >> the Court Held:
The Appellate Division revered and remanded the Trial Court’s denial of Husband’s request to testify via video as Husband was in India and could not get a Visa to enter the United States.
The Appellate Division ruled that trial courts considering whether to permit testimony by contemporaneous video transmission should first inquire into the scope and substance of the proposed testimony and whether that testimony is in dispute, along with the significance of the witness's credibility and demeanor and the cost to the parties in requiring in-person testimony.
