In a Decision – Milcarsky v. Milcarsky, , (an Unpublished Opinion) >> the Court Held:
The Appellate Division affirmed the Trial Court determination that physical separation and the payment of support did not equal the clear termination of a marriage. The date the marriage ended was the date the divorce complaint was filed. Physical separation and the payment of support did not equal the clear termination of a marriage. The parties separated in 2004 and that all property acquired after that should not be subject to equitable distribution. The Wife qualified for open durational alimony. Husband was not obligated to maintain the marital standard of living since it had not been the status quo for either party for a long time.
