The Appellate Division affirmed the Decision of the Trial Court that did not find Domestic Violence because Plaintiff claimed harassment and Harassment did not occur.
The court found that an assertion by a plaintiff that she felt harassed was a subjective belief and insufficient to prove a purpose or intent to harass. The court agreed with the trial judge who found that the evidence plaintiff presented was inconsistent and contradicted by her actions. Appellate Division determined that plaintiff did not establish a predicate act of domestic violence.
