In a Decision – David v. Wynn, (an Unpublished Opinion) >> the Court Held:
The Appellate Division reversed and remanded the Family Part decision denying a Motion. The Trial Court had denied the Motion without provided no reasons for denying the portions of appellant's motions that were involved in the instant appeal. As a result, the court had no way of knowing why the trial court decided to deny appellant's request. The Appellate Division reversed that Decision based upon the Trial Court’s failure to explain its reasoning. The trial court's failure to provide the requisite findings of fact and conclusions of law, necessitated a remand for fulfilment of the trial court's obligation.
Rule 1:7-4(a) clearly stated that a trial "court shall, by an opinion or memorandum decision, either written or oral, find the facts and state its conclusions of law thereon . . . on every motion decided by a written order that is appealable as of right[.]" Shulas v. Estabrook, 385 N.J. Super 91, 96 (App. Div. 2006).
