The Appellate Division reversed the Final Restraining Order (“FRO”) entered against defendant, agreeing that the trial court erred in entering an FRO based on a predicate act of harassment when plaintiff's complaint only alleged acts of assault.
It was contended that he was deprived of his due process rights because the court found she satisfied the predicate act of harassment, despite the complaint only alleging an act of assault.
