In a Decision – Stanton v. Sembrat, (an “Unreported Decision") >> the Court Held:
The Appellate Division determined that even though an Order set forth that no payment was to occur to child support arrears, a redirected Worker’s Compensation payment was entitled to be retained.
Plaintiff did nothing to cause the $3,800 intercept. The money was put in her bank account and she spent it. Plaintiff told the court she had spent the unexpected funds on necessities, had no funds to repay defendant and needed the weekly child support. The lower court's decision was within its equitable powers, especially in light of the large outstanding arrearages accumulated by defendant prior to the April 2018 order.
