The Appellate Division affirmed the Trial Court decision that Husband’s
failure to properly report his income allowed the court to determine
Husband’s income
Court found Husband's credibility lacking as to the benefits he received from a trust fund and his mother. Husband and his mother conspired to ensure that Husband never showed any reportable income. Trial judge found defendant's failure to call his mother as a witness allowed judge to take an adverse inference and judge imputed an income to Husband in excess of the income claimed by Husband.
